Law and Children

Any matter dealing with family and children has to be handled in a sympathetic and professional manner. The Practice has developed particular expertise in relation to Divorce and Children proceedings involving Foreign Jurisdictions, which can have important consequences.

If a marriage was entered into outside England and Wales important questions about the validity of the marriage will need to be addressed, likewise if a Divorce is pronounced in a Foreign Jurisdiction. The validity of such will be dependant on the parties' domicile and habitual residence, which are difficult questions of Law to be determined.

Once the marriage has come to an end if there are any children their future need have to be determined. Contrary to popular belief it is not always the case that "the wife has the children." In fact both parents can apply for either a residence order so that the child stays with them or contact order i.e. Visiting rights at agreed times. There are a number of other orders and parties who can apply for these orders under the children 's Act 1989.
